§ 40-2. Board established.

(a) In general.

The Environmental Control Board of Baltimore City is established as an independent agency of City Government.

(b) Composition.

(1) The Board comprises 15 members.

(2) 7 are the following ex officio members, or their respective designees:

(i) the Commissioner of Health;

(ii) the Commissioner of Housing and Community Development;

(iii) the Police Commissioner;

(iv) the Fire Chief;

(v) the Director of Public Works;

(vi) the Director of Transportation; and

(vii) a member of the City Council, to be appointed by the President of the City Council.

(3) 8 members are appointed by the Mayor in accordance with Article IV, § 6 of the City Charter.

(c) Qualifications of appointed members.

Of the members appointed under subsection (b)(3) of this section:

(1) 2 members must be appointed from the general public; and

(2) 6 members must be appointed with at least 1 designated as having expertise in each of the following areas:

(i) real estate;

(ii) small business;

(iii) education;

(iv) water pollution;

(v) solid waste; and

(vi) community advocacy.

(d) Chair.

The Chair of the Board is appointed by the Mayor from among the members.

(e) Compensation; expenses.

The members appointed under subsection (b)(3) of this section:

(1) serve without compensation; but

(2) are entitled to reimbursement for reasonable expenses incurred in the performance of their duties, as provided in the Ordinance of Estimates.
