§ 7-2. Ballast under tracks.

If any public street in the City, upon which the tracks of any corporation or individual are maintained, is paved or repaved at the expense, either in whole or in part, of the Mayor and City Council of Baltimore or of the abutting property owners, the corporation or individual, in addition to all other obligations of the corporation or individual, shall be required to place under the tracks, to prevent them from sinking, broken stone or gravel ballast whenever, in the judgment of the Department of Transportation, the existing ballast or the natural formation of the soil under the tracks is insufficient.
