§ 7-3. Maintenance in good repair.

(a) Obligation of owners.

The owners of all railroad tracks and switches and all railroad companies operating thereon shall at all times keep the tracks and switches and the space between the rails of the tracks and switches in good condition and repair.

(b) Work by Public Works.

If any owner or railroad company fails or neglects to make repairs promptly and properly, the Department of Transportation is authorized to have the same done in a good and sufficient manner, at the expense of the owner and railroad company.
